Refusals, Cancellations & Appeals

A refusal or cancellation is rarely the end of the road — but the clock starts the day the decision is made.

What it is

Many refusals and cancellations can be reviewed on their merits by the Administrative Review Tribunal (the ART, which replaced the AAT in October 2024). The Tribunal takes a fresh look at the decision and can substitute its own. Beyond the ART, options can include judicial review in the courts, a request for ministerial intervention, or a stronger fresh application.

Good to know
  • Deadlines are strict and short — often around 21 to 28 days, sometimes less — and generally can't be extended
  • A refusal onshore can trigger the section 48 bar, limiting what you can apply for next while in Australia
  • Bridging visa and work-rights implications need managing from day one

General eligibility — in brief

  • Review rights depend on the visa type, and where you and the decision were made — check your decision letter
  • Apply to the ART within the deadline in the decision letter
  • The Tribunal reconsiders the facts and law afresh — new evidence can be provided
  • Character-based cancellations follow different, tighter rules
  • Ministerial intervention is discretionary and generally a last resort
  • Get advice before reapplying — the refusal record follows you
